USCIS filing rules are changing—is your Green Card renewal due?
- By Fileright
- Last Updated:
USCIS is changing how it handles certain filing deadlines starting October 23, 2026. Under the updated guidance, some paper filing deadlines can move to the next business day when they fall on a weekend or federal holiday. Others, such as deadlines based on a person’s age, cannot.
The news is a reminder to check your own immigration documents. For Green Card renewal, start with the expiration date on your card. If your 10-year Green Card has expired or will expire within six months, it is time to prepare your renewal application.
You can take that next step with FileRight’s online Form I-90 preparation service.
What is changing? Two simple examples
The USCIS update explains when a weekend or federal holiday gives someone extra time to submit a paper filing.
Example 1: A deadline counted in days
Suppose the rules give someone 30 days to submit a qualifying paper filing, and the last day falls on Sunday.
USCIS can consider the filing on time if it receives it on Monday. If Monday is a federal holiday, the next business day would be Tuesday.
What this means: Certain paper deadlines counted in days can move to the next business day.
Example 2: A deadline based on age
Suppose someone must submit an application before turning 21, and their birthday falls on Sunday.
They cannot wait until Monday and still meet that age requirement. They must make sure USCIS receives the application while they are still eligible.
What this means: A weekend does not give someone extra time to meet an age requirement.
The guidance applies to paper filings received on or after October 23, 2026. The rule depends on the filing and its deadline.
How do you know whether your Green Card renewal is due?
For a standard 10-year Green Card, check whether your card:
- Has already expired, or
- Will expire within the next six months.
If either applies, USCIS directs permanent residents to renew their card using Form I-90, Application to Replace Permanent Resident Card.
For example: If your card expires in four months, you are within the usual renewal window. If it expires in nine months, plan ahead and wait until the appropriate window to submit a standard renewal.
Your renewal timing depends on your card’s expiration date. October 23 is the effective date of the filing-policy update.
Why start preparing now?
Starting when renewal is due gives you time to gather documents, check your answers, and work through questions before submitting.
For example, if you have legally changed your name since your last Green Card was issued, you may need supporting records showing that change. Checking early gives you time to find the documents required by the Form I-90 instructions.
If your card is already expired or will expire within six months, take the first step today.
